Disclaimer: This blog is not intended to be legal advice and is only meant to be used for educational reasons. You are responsible for staying up to date on the most recent medical marijuana laws because they change constantly.

Due to Mississippi’s legalization of medicinal marijuana, its citizens can now get relief from certain qualifying medical ailments. Cannabis use in medicinal settings is spreading as more people have access to its therapeutic benefits.

Patients who use medical marijuana should feel at peace when using cannabis-based products. However, new patients could feel apprehensive about the medical treatment’s legal requirements. For Mississippi citizens who have been granted approval, medicinal marijuana is lawful, but driving with medical marijuana is a common concern.

If you have a Mississippi medical marijuana ID card, we want to reassure you that it is OK to drive in Mississippi while in possession of marijuana for medical purposes. Here is all the information you require:

Driving while carrying medicinal marijuana

Driving while in possession of medicinal marijuana is permitted for registered medical marijuana patients and caregivers (if the patient is a minor). If a patient is taking their medication elsewhere or driving home from a dispensary, they are permitted to keep medicinal marijuana in their car. You must carry the medical marijuana identification card provided by your state.

The use of medical marijuana in a car, however, is prohibited. A patient may not use medicinal marijuana while operating a car or be in any way impaired by it while doing so. Other locales where marijuana use is forbidden include:

  • Public transportation of any kind
  • School bus
  • Aircraft
  • Motorboat

Taking medical cannabis across state lines

Even though Mississippi and a few other states have legalized medicinal marijuana, it is still illegal on a federal level. Even if a state has approved medical marijuana, carrying it into another state is prohibited and might be viewed as drug trafficking. Never take medical marijuana beyond state boundaries.

Being Stopped with Medical Marijuana

You have protection from unreasonable searches and seizures if you live in Mississippi. However, a police officer is lawfully permitted to search your car if they have a good reason. “Probable cause” simply means that the police has sufficient grounds to believe that the vehicle is carrying illegal goods or that marijuana products are readily accessible.

You are in compliance with the law and need not be concerned if you are not impaired at the time you are stopped. To be on the safe side of the law, always bring your Mississippi medical marijuana card when you travel. When in possession of medicinal marijuana, it may be a second-degree misdemeanor to fail to show your ID card.

Driving with medical marijuana is legal for registered patients and caregivers. However, just as you would never drink and drive, never drive while under the effects of marijuana.
