The psychoactive compound delta-8 tetrahydrocannabinol (or delta-8 THC) is derived from the Cannabis sativa plant, of which both marijuana and hemp are subspecies. Although delta-8 THC is one of over 100 cannabinoids naturally produced by the cannabis plant, it is rarely present in the plant. Therefore, cannabidiol extracted from hemp is typically used to produce high concentrations of delta-8 THC (CBD).

Important information for consumers to know is that the FDA has not evaluated delta-8 THC products for safety in any setting. As they could be marketed in ways that are harmful to the general populace, they should be stored safely and kept out of the reach of children and animals.

What are the Benefits of Delta-8 THC?

Delta-8 THC, like delta-9 THC, can cause euphoria, relaxation, and possibly pain relief; however, these effects are significantly less intense.

There is still not enough information available about delta-8 THC to confirm that the benefits outweigh the potential risks, especially legally. Since delta-8 is a synthetic compound, its constituents are unknown, which poses additional safety concerns.

Is Delta-8 THC Legal in Mississippi?

Yes! A recent report by local news station WLOX out of Biloxi, MS, explains that while THC is illegal on the federal and many state levels, delta 8 THC is not. This includes Mississippi. In fact, veteran narcotics officer Joe Nicholson stated that “So what we’re seeing being sold in vape pens in these vape shops is Delta 8…t’s a strain of marijuana. Delta 8 is illegal in Mississippi.” However, the news report went on to elaborate that Nicholson explained a loophole: “Except, they’re putting it in vape pens, and the vape pen itself is less than a milliliter…Our state statute defines a dosage unit as a milliliter or more.”

In fact, Mississippi Code 41-29-139 states that a dosage unit is required by law enforcement in the state of Mississippi in order to file charges. That’s why vape shops that provide it aren’t breaking the law, on a technicality.

Legal Alternatives to Delta-8 THC

While Delta-8 is in a bit of a legal gray-area in Mississippi, some individuals may not feel comfortable with the risk, especially given the lack of research on Delta-8 by the FDA.
