Delta 8 is illegal in Mississippi.” However, the news report went on to elaborate that Nicholson explained a loophole: “Except, they’re putting it in vape pens, and the vape pen itself is less than a milliliter…Our state statute defines a dosage unit as a milliliter or more.”
In fact, Mississippi Code 41-29-139 states that a dosage unit is required by law enforcement in the state of Mississippi in order to file charges. That’s why vape shops that provide it aren’t breaking the law, on a technicality.
